1. Acceptance of Terms

By accessing or using QR Code Nova ("the Service"), operated by QR Code Nova ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. You must be at least 16 years old to use the Service.

2. Description of Service

QR Code Nova provides a platform for creating, managing, and tracking QR codes. The Service includes static QR code generation, dynamic QR code management, scan analytics, team collaboration, custom domains, API access, and related tools available through our web application.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate and complete information, keep your credentials secure, and notify us promptly of any unauthorized use. You are responsible for all activity under your account, including activity by team members you invite.

If you create a team or workspace, you are responsible for the actions of all members within it and for ensuring their compliance with these Terms.

4. Subscription Plans & Billing

The Service offers free and paid subscription plans. Paid plans are available with monthly or annual billing. By subscribing, you authorize us to charge your payment method on a recurring basis through our third-party payment processor. You may cancel at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Plan upgrades take effect immediately. Downgrades take effect at the end of the current billing period. Features exclusive to higher plans (such as custom domains or team seats) will be deactivated upon downgrade.

If a payment fails or is declined, access to paid features will be suspended until the payment issue is resolved. We are not liable for any loss or disruption resulting from failed or delayed payments.

Refunds are handled on a case-by-case basis. Contact us at support@qrcodenova.com for refund requests.

5. QR Code Permanence

We are committed to keeping your QR codes working. Dynamic QR codes created through the Service will continue to redirect to their designated destinations even if you cancel or downgrade your subscription. Upon cancellation, you will lose access to analytics, editing, and management features, but existing QR redirects will remain active.

This commitment is subject to the following exceptions. We reserve the right to deactivate QR codes that:

  • Violate our Acceptable Use policy (Section 6)
  • Redirect to content that is illegal, harmful, or infringing
  • Are used for phishing, malware distribution, or fraud

In the event that QR Code Nova ceases operations permanently, we will make reasonable efforts to provide at least 90 days' notice to account holders via email, during which you may update your destination URLs or make alternative arrangements. After this notice period, we cannot guarantee continued redirect functionality.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Distribute malware, phishing content, or other harmful material
  • Generate QR codes that redirect to illegal, fraudulent, or deceptive content
  • Attempt to interfere with or disrupt the Service or its infrastructure
  • Circumvent usage limits, rate limits, or access controls
  • Resell or redistribute the Service without written authorization
  • Use the Service in a manner that could damage, disable, or impair the Service for other users

We reserve the right to suspend or terminate accounts and deactivate QR codes that violate these terms, with or without prior notice depending on the severity of the violation.

7. Custom Domains

Certain plans allow you to use your own domain for QR code redirects. You represent that you own or have proper authorization to use any custom domain configured through the Service. You are solely responsible for the content served under your custom domain.

Custom domain functionality is tied to your active subscription. If you downgrade to a plan that does not include custom domains, the custom domain configuration will be deactivated, though QR redirects will continue to function through our default domain.

8. API Usage

Access to the QR Code Nova API is subject to rate limits and quotas defined by your subscription plan. You agree not to exceed your allocated API quota, and we reserve the right to throttle or suspend API access for accounts that consistently exceed their limits. API access may be revoked if used in violation of these Terms.

9. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by QR Code Nova and protected by intellectual property laws. You retain ownership of the content you create using the Service (e.g., QR destination URLs, uploaded logos).

10. User Content & Data

You retain all rights to the content and data you provide through the Service. By using the Service, you grant us a limited license to process your content as necessary to provide the Service. Your data is governed by our Privacy Policy.

You may request an export of your data at any time by contacting support@qrcodenova.com. Upon account deletion, we provide a grace period during which you can cancel the request. After the grace period, your data will be permanently removed within 30 days, except where retention is required by law.

11. Third-Party Services

The Service integrates with third-party providers for payment processing, authentication, email delivery, hosting, security, and analytics. By using the Service, you acknowledge that your data may be processed by these providers in accordance with their own terms and privacy policies. We are not responsible for third-party practices.

12. Indemnification

You agree to indemnify and hold harmless QR Code Nova, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) content you create, link to, or distribute through QR codes generated by the Service; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service downtime or interruptions.

14. Limitation of Liability

To the maximum extent permitted by applicable law, QR Code Nova shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes or limits warranties that cannot be excluded under applicable law, including EU consumer protection laws.

16. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases, but QR code redirects will remain active as described in Section 5.

Accounts that remain inactive (no login) for 12 consecutive months may be deleted after we send a prior notice to the email address on file. Associated QR codes and data will be permanently removed upon account deletion.

17. Dispute Resolution

In the event of a dispute arising from these Terms or your use of the Service, both parties agree to first attempt to resolve the matter informally by contacting legal@qrcodenova.com. If the dispute cannot be resolved within 30 days, it shall be submitted to the courts of Spain.

If you are a consumer in the European Union, you retain any rights to bring proceedings in the courts of your country of residence. You may also use the European Commission's Online Dispute Resolution platform.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. For significant changes, we may also notify you via email. Your continued use of the Service after changes constitutes acceptance of the updated terms.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. If you are a consumer in the European Union, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence.
